Big relief to AAP MP Sanjay Singh from Supreme Court
Got bail after six months
The Supreme Court granted bail to AAP MP Sanjay Singh in a money laundering case related to the Delhi Excise Policy scam. A bench of Justice Sanjiv Khanna, Justice Dipankar Dutta and Justice PB Varale on Tuesday ordered bail to Sanjay Singh, who has been in jail for six months. During the hearing, the Enforcement Directorate said that it has no objection if the AAP leader is granted bail in the case.
Question was asked to ED
Earlier, the Supreme Court had asked the ED whether there was a need to keep Singh in custody for some more time? The Supreme Court had told the ED that if there is a need for the custody of AAP leader Sanjay Singh in the Delhi Excise Policy scam case, then it should be informed about it after the lunch break.
Apart from this, the top court said that AAP leader Sanjay Singh has spent six months in jail and there is an allegation against him of taking a bribe of Rs 2 crore. These allegations can be investigated during the trial.
Debate between Singh's lawyer and Justice
Senior advocate Singhvi, appearing for Singh, said you are considering the issue of 'need' for arrest. This section 19 is important for PMLA. He read out Section 19 (1) and also referred to the decision of Vijay Madanlal Chaudhary.
Justice Khanna said on this that please speak on the correct facts. On this, Singhvi said that the main witness of Enforcement Directorate (ED) Dinesh Arora had not taken the name of Sanjay Singh in his earlier nine statements. On this, Khanna said whether Dinesh Arora got pardon in the CBI case on 16 November 2022?
On this Singhvi said that till then Singh's name was not in his statements. Dinesh Arora was sent to judicial custody, after which he made allegations for the first time.
Was arrested on October 4
In the last hearing, senior lawyer Abhishek Manu Singhvi, appearing for Sanjay Singh, had said that Enforcement Directorate (ED) key witness Dinesh Arora had not taken Sanjay Singh's name in his earlier nine statements. Singhvi had said in the court that the testimony of the approver is not reliable unless it is confirmed.
Let us tell you, Sanjay Singh's name appeared for the first time in the statement of Dinesh Arora, who became the approver on July 19, 2023. Even in the statement of 164, the name was not taken. Sanjay Singh filed a (defamation) complaint against ED and then ED arrested him without any summons. The High Court had rejected Singh's bail plea on February 7, but had directed the lower court to expedite it once the hearing began. Singh has been re-elected to the Rajya Sabha from Delhi. The Enforcement Directorate had arrested Singh in the case on October 4, 2023.
