IAS Sanjeev Hans did not get relief
Patna HC refused to stay punitive action
Patna, Patna High Court refused to stay punitive action on the action of Special Surveillance Unit Police Station Case No. 5/24 registered against senior IAS officer Sanjeev Hans. The court ordered the Special Surveillance Unit to file its objection. Justice Arvind Singh Chandel heard the matter.
At the same time, the single bench of Justice Arvind Singh Chandel, while hearing the case, has ordered SVU to file an objection. Advocate Suraj Samdarshi, on behalf of the applicant, pleaded to the court to cancel the case registered in SVU police station. He said that in recent times the High Court has canceled the case registered under other sections including rape. During this case, ED conducted an investigation under the Prevention of Money Laundering Act. He said that SVU registered the case on the information of ED without verifying the facts.
He currently pleaded for interim protection in this case. On the other hand, Special SVU lawyer Rana Vikram Singh and advocate Suman Kumar Jha on behalf of the state government strongly opposed the petition and demanded time to file their reply. On this, the court fixed the date of next hearing as November 13.
Advocate Suraj Samdarshi on behalf of the applicant requested the court to cancel case number 5/24 registered in Special Surveillance Unit police station under sections 7, 12, 13 (1) (A), 13 (1) (B) and 13 (2) of the Prevention of Corruption Act and sections 61 and 318 (4) of the Indian Penal Code. He said that in recent times the High Court has canceled the FIR registered under other sections including rape. During this case, the Enforcement Directorate conducted an investigation under the Prevention of Money Laundering Act. Enforcement Directorate Patna Zonal Office shared some information with the Special Vigilance Unit through its letter number ECIR/PTZO/04/2024/714 dated 28.08.2024.
On the basis of that information, the Special Vigilance Unit registered Special Vigilance Unit Police Station Case No. 5/2024 on 14.09.2024 under sections 61, 318 (4) of the Indian Justice Code and sections 7, 12, 13 (1) (A), 13 (1) (B) and 13 (2) of the Prevention of Corruption Act. He said that the Special Vigilance Unit registered the case without verifying the facts and without conducting any preliminary investigation into the information given by the Enforcement Directorate. He told the court that it is legally wrong to register this case because a case has already been registered. He requested for interim protection in this case for the time being.
